____________

WHEREAS, the Board of Education is committed to ensuring that all students who attend its schools, regardless of immigration status, can safely access a free public education; and

WHEREAS, since the U.S. Supreme Court’s 1982 decision, Plyler v. Doe, federal law has recognized the right of all children, regardless of immigration status, to enroll in public school; and

WHEREAS, in order to learn and thrive, children must know that the school district will support their safety and emotional well-being regardless of their disability, race, creed, color, sex, sexual orientation, gender identity, gender expression, marital status, national origin, religion, veteran status, ancestry immigration status, or need for special education services; and

WHEREAS, the Board adopted the Innovation 2030 Strategic Plan, which values and prioritizes family and community partnerships with the understanding that our students need their parents, guardians, and other adults in their lives for their wellbeing and to fully realize educational success; and

WHEREAS, the Board adopted policies and practices that support educational opportunities for all students and represents the diverse families in our communities so that students can access their education as guaranteed by the Colorado Constitution, and both Colorado and federal law; and

WHEREAS, the federal government has announced plans for nationwide immigration enforcement actions; and

WHEREAS, these announcements have created confusion and anxiety in the school community, resulting in some of the district’s families, students, and staff to feel insecure and unsafe, particularly surrounding their right to continue to access a free public education through district schools and programs; and

WHEREAS, educational personnel are often the primary sources of support, resources, and information to assist and support students and student learning, which includes their emotional health.

NOW, THEREFORE, BE IT RESOLVED, the School District shall follow all state and federals laws to protect our students and families, regardless of immigration status, including but not limited to the following actions:

  • The School District will continue its practice to not collect or maintain any information about our students' or their families’ or guardians’ immigration status.  Under federal law, Greeley-Evans School District 6 will continue its enrollment and registration practices, which does not collect any information about students’ migration documentation.
  • The School District shall assist families in keeping emergency contacts up to date and otherwise support families in finding resources to make emergency plans should families feel a need to do so, and shall provide support to students who may feel that they and their families are at risk.
  • Schools shall forward to the School District’s Office of Legal Counsel any request by federal immigration officials:
  • for entry into any School District school or other School District property
  • to communicate with any student while that student is under the supervision of the School District during any school activity or while using School District transportation
  • for any information about our students or families

BE IT FURTHER RESOLVED, that the Board of Education restates its commitment to creating safe and secure school conditions through its policies prohibiting bullying, discrimination, and harassment.

BE IT FURTHER RESOLVED, that the School District shall broadly communicate the commitments of this Resolution.

ADOPTED by the Greeley-Evans School District 6 Board of Education on this 27th day of January, 2025.
